    The 2012 Diversity Visa Green Card Lottery

    Every year, the U.S. Department of State conducts a congressionally-mandated lottery called the Diversity Visa Lottery program that grants around 50,000 U.S. permanent resident visas to foreign nationals who meet certain eligibility standards specified by the U.S. law. Such diversity visas are available only to nationals of countries with relatively low U.S. immigration rates. Under this visa lottery program, successful participants are granted permanent residence and work status.

    Diversity Visa Lottery Process and Distribution

    The visas are distributed on a regional basis. The maximum number of visas under the visa lottery program will go to regions with lower rates of immigration to the U.S.

    No visas will go to citizens of countries sending more than 50,000 immigrants to the U.S. in the past 5 years.

    Foreign nationals belonging to countries, such as Hong Kong SAR, Macau SAR, and Taiwan are also eligible.

    It should be noted that in a year, no single country can receive more than 7% of the total number of visas.

It must be noted that the one-month registration period for submitting an entry to register for the U.S. Green Card Lottery 2012, also known as DV-2012, ended at noon on 3 November 2010, Eastern Daylight time.

    The 2010 Diversity Immigrant Visa Program, commonly referred to as the “Green Card Lottery” or “US Immigration Lottery,” is scheduled to close on November 3.  In previous years, the program allowed submissions of applications during an approximate 2-month period.  This year, however, the entry period has been cut by about half.  The 2010 Visa Lottery opened on October 5.  Because of the shortened window during which entries can be submitted, all interested applicants are urged to act immediately to avoid delays caused by high traffic.  Updated information about the 2010 program, including an electronic registration form, are available from the USA Green Card service site at http://www.usa-green-card.com

    The Congressionally mandated Diversity Immigrant Visa Program is administered on an annual basis by the Department of State and conducted under the terms of Section 203(c) of the Immigration and Nationality Act (INA).  Section 131 of the Immigration Act of 1990 (Pub. L. 101-649) amended INA 203 and provides for a class of immigrants known as “diversity immigrants.”  Section 203(c) of the INA provides a maximum of 55,000 Diversity Visas (DVs) each fiscal year to be made available to persons from countries with low rates of immigration to the United States.  For fiscal year 2012, 50,000 DVs will be available.

    The annual DV program makes visas available to persons meeting simple, but strict, eligibility requirements.  A computer-generated, random lottery drawing chooses selectees for DVs.  The visas are distributed among six geographic regions, with a greater number of visas going to regions with lower rates of immigration, and with no visas going to nationals of countries sending more than 50,000 immigrants to the United States over the period of the past five years.  Within each region, no single country may receive more than 7% of the available DVs in any one year.

    The Department of State implemented the electronic registration system beginning with DV-2005 in order to make the DV process more efficient and secure.  The Department utilizes special tecnology and other means to identify those who commit fraud for the purposes of illegal immigration or those who submit multiple entries.

    Diversity Visa Lottery 2011 DV-2011 Results.

    The Kentucky Consular Center in Williamsburg, Kentucky has registered and notified the winners of the DV-2011 diversity lottery. The diversity lottery was conducted under the terms of section 203(c) of the Immigration and Nationality Act and makes available *50,000 permanent resident visas annually to persons from countries with low rates of immigration to the United States. Approximately 100,600 applicants have been registered and notified and may now make an application for an immigrant visa. Since it is likely that some of the first *50,000 persons registered will not pursue their cases to visa issuance, this larger figure should insure that all DV-2011 numbers will be used during fiscal year 2011 (October 1, 2010 until September 30, 2011).

    Applicants registered for the DV-2011 program were selected at random from over 12.1 million qualified entries (16.5 million with derivatives) received during the 60-day application period that ran from noon on October 2, 2009, until noon, November 30, 2009. The visas have been apportioned among six geographic regions with a maximum of seven percent available to persons born in any single country. During the visa interview, principal applicants must provide proof of a high school education or its equivalent, or show two years of work experience in an occupation that requires at least two years of training or experience within the past five years. Those selected will need to act on their immigrant visa applications quickly. Applicants should follow the instructions in their notification letter and must fully complete the information requested.

    Registrants living legally in the United States who wish to apply for adjustment of their status must contact U.S. Citizenship and Immigration Services for information on the requirements and procedures. Once the total *50,000 visa numbers have been used, the program for fiscal year 2011 will end. Selected applicants who do not receive visas by September 30, 2011 will derive no further benefit from their DV-2011 registration. Similarly, spouses and children accompanying or following to join DV-2011 principal applicants are only entitled to derivative diversity visa status until September 30, 2011.

    Only participants in the DV-2011 program who were selected for further processing have been notified. Those who have not received notification were not selected. They may try for the upcoming DV-2012 lottery if they wish. The dates for the registration period for the DV-2012 lottery program will be widely publicized during August 2010.

    * The Nicaraguan and Central American Relief Act (NACARA) passed by Congress in November 1997 stipulated that up to 5,000 of the 55,000 annually-allocated diversity visas be made available for use under the NACARA program. The reduction of the limit of available visas to 50,000 began with DV-2000.

    USCIS Announces Its Intent to Certify U Visa Applications

    It has been announced by the U.S. Department of Labor (DOL) that it has determined to certify U visa applications in favor of victims of certain crimes. Previously, only the traditional law enforcement offices were authorized to certify U visas for immigrant victims. Thus this transition can be termed as a major change.

    The foreign nationals who are victims of certain crimes are encouraged to volunteer themselves and coordinate with the law enforcement forces through U visa. Individuals who are beneficiaries of the U visa are allowed to stay in the Unites States for up to four years. Further, the visa allows the individual to bring some of their family members into the U.S. and also grants automatic work authorization along with possibilities of obtaining the green card.

    The immigrant victim is obliged to file USCIS Form I-918 along with the U visa application. A foreign national is eligible to apply for the U visa only if a law enforcement agency approves that the individual has been a victim of a crime and is cooperative while investigating or prosecuting those suspected of committing the crime. The applicant should be victim of physical or mental abuse in any of the criminal activities, including rape, sexual assault, female genital mutilation, witness tampering, blackmail, kidnapping, murder, slave trade, perjury, and other associated crimes.

    Prior to applying for U visas, the U.S. Citizenship and Immigration Services (USCIS) Form I-918 Supplement B should be filled by a law enforcement agency with all the documents about the victim. The U.S. Department of Homeland Security has authorized the U.S. DOL as one of the law enforcement agencies.

    Foreign nationals who have been traded to work illegally in the United States or ill-treated by the employers will be given U visa protection by the DOL. If the employer threatens an employee of the consequences that he/she would face after cooperating with a government investigation, it would be recognized as witness tampering thus qualifying the individual for U visa certification.
